1. Acceptance of Terms
By booking an appointment, purchasing a treatment, or using the services of Little Gem Holistic Spa (“Little Gem”, “the Spa”, “we”, “us”), you agree to the following Terms and Conditions. These terms govern all bookings, services, payments, and interactions with the practice.
2. Booking Policy
Appointments may be made through the website, telephone, WhatsApp, or in person.
All bookings are subject to availability and are only confirmed once the client receives confirmation from Little Gem.
Little Gem reserves the right to decline or reschedule appointments if necessary for operational, health, or safety reasons.
To secure certain treatments or packages, the Spa may require a deposit or full prepayment at the time of booking.
Deposits are applied toward the treatment cost.
Failure to confirm payment within the required timeframe may result in automatic cancellation of the booking.
3. Deposits and Prepayments
To secure appointment times and prevent lost booking slots, Little Gem may require a deposit of up to 50% of the treatment value.
Deposits may be required for:
- Extended treatments
- After-hours bookings
- Packages
- Group bookings
- Special treatments
Deposits are non-refundable but may be transferred if cancellation occurs within the permitted timeframe.
4. Cancellation Policy
Little Gem operates a strict cancellation policy to ensure fair access to appointment times.
Clients may cancel their booking at any time; however, cancellation fees may apply depending on the notice period.
The following cancellation structure applies:
More than 48 hours before appointment
No cancellation fee. Deposit may be transferred to a new booking.
24–48 hours before appointment
50% cancellation fee.
Less than 24 hours before appointment
100% cancellation fee.
No-shows
The full treatment fee is payable.
Under South African law, businesses may charge a reasonable cancellation fee for advance bookings, provided it reflects the actual losses incurred by the supplier.
5. Exceptions to Cancellation Fees
Cancellation fees will not be charged if the client cannot attend due to:
- Death of the client or immediate family member
- Hospitalisation or medical emergency
These exceptions align with provisions under the Consumer Protection Act.
Documentation may be requested.
6. Late Arrival Policy
Clients arriving late may have their treatment time shortened to avoid delaying other appointments.
If arrival is more than 15 minutes late, Little Gem reserves the right to:
- shorten the treatment
- reschedule the appointment
- treat the booking as a cancellation
Full charges may still apply.
7. After-Hours Appointments
Little Gem offers after-hours appointments to accommodate working individuals.
After-hours appointments:
- must be booked in advance
- may require full prepayment
- may include an additional service fee
Failure to attend after-hours bookings without notice may result in the full treatment fee being charged.
8. Health and Medical Disclosure
Clients must disclose any relevant medical conditions before treatment.
This includes but is not limited to:
- pregnancy
- skin conditions
- allergies
- injuries
- heart conditions
- recent surgery
- medication affecting skin or circulation
Failure to disclose relevant health information may affect treatment results and may void any liability claims against the Spa.
Little Gem reserves the right to refuse treatment if it may compromise client health or safety.
9. Baby and Child Treatments
Baby and toddler treatments are conducted with the utmost care.
Parents or legal guardians must:
- remain present during the treatment
- disclose any health conditions
- confirm consent for the treatment
Little Gem may decline baby treatments if it believes the treatment may not be suitable for the child.
10. Natural Ingredient Treatments
Little Gem specialises in treatments made with fresh, natural ingredients such as oats, honey, herbal infusions, and plant-based mixtures prepared per session.
Clients must inform the therapist of:
- allergies
- sensitivities
- dietary ingredient reactions
Little Gem cannot be held responsible for allergic reactions where ingredient sensitivities were not disclosed.
11. Treatment Results Disclaimer
Results from treatments vary between individuals.
Little Gem does not guarantee specific medical or cosmetic outcomes.
Treatments are provided for relaxation, wellness, and cosmetic purposes.
They do not replace medical treatment.
12. Liability Waiver
Clients agree that:
- all treatments are undertaken at their own risk
- Little Gem and its therapists are not liable for injuries or reactions resulting from undisclosed medical conditions
- the Spa is not responsible for loss, theft, or damage of personal belongings
Clients must follow all aftercare instructions.
13. Gift Vouchers
Gift vouchers:
- are valid for 12 months from date of purchase
- are non-refundable
- may not be exchanged for cash
Lost or stolen vouchers cannot be replaced.
14. Pricing and Payments
Prices are listed in South African Rand and may change without prior notice.
Payments may be made via:
- EFT
- card
- approved digital payment methods
Full payment must be completed before or immediately after treatment.
15. Refusal of Service
Little Gem reserves the right to refuse service if:
- a client behaves inappropriately
- a client is under the influence of alcohol or drugs
- health conditions make treatment unsafe
- the client violates Spa policies
16. Privacy and Personal Information
Little Gem collects personal information solely for:
- booking management
- health records
- communication regarding appointments
Information is handled in accordance with POPIA (Protection of Personal Information Act).
Personal information will never be sold or shared without consent.
17. Website and Online Bookings
When booking online, clients agree that:
- information provided is accurate
- booking confirmations are sent electronically
- deposits and cancellation policies apply equally to online bookings
18. Amendments
Little Gem reserves the right to update these Terms and Conditions at any time.
Updated terms will be published on the website.
19. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa, including:
- Consumer Protection Act 68 of 2008
- Protection of Personal Information Act
- South African contract law
